Privacy

Scope:

It is one of Panacea’s core values to properly protect its Customers’ and Users’ information. This policy describes how Panacea will safeguard personal and company data.

Policy:

  1. Panacea is committed to the protection of Customers’ and Users’ privacy in relation to Panacea Software.

  2. The confidentiality of all Customer Data will be protected in accordance with the Terms of Use: https://www.panacea-software.com/terms-of-use

  3. Information provided to Panacea by which Users can be identified will only be used by Panacea in accordance with this privacy statement.

Customer’s Responsibilities:

  1. The Customer is the Data Controller of all Customer Data entered on Panacea Software or disclosed to Panacea.

  2. The Customer must obtain the consent of any individual whose personal information it intends to disclose to Panacea or input and process on Panacea Software in accordance with this policy.

  3. The Customer is responsible for controlling the access to Panacea Software and the Customer Data provided to its Users.

  4. The Customer and Users acknowledge that data on Panacea Software can be accessed by other Users and by Panacea. Therefore, the Customer and Users are responsible for ensuring that Customer Data does not include any personal or other information which, when accessed, may compromise the privacy of the individual.

  5. The Customer acknowledges that details of Panacea Software and Services and the results of any performance tests on the Services constitute Panacea's Confidential Information.

  6. Customers and Users should check this page occasionally to ensure they are happy with any changes to this policy.

  7. The Customer acknowledges and agrees that Panacea and/or its licensors own all intellectual property rights in the Software, the Services and related Documentation. Except as expressly stated herein, the Customer shall have no rights to, or in, patents, copyrights, database rights, trade secrets, trade names, trademarks (whether registered or unregistered), or any other rights or licenses in respect of the Software, the Services or the related Documentations.

  8. Customers and Users acknowledge that the transmission of information over the internet is inherently insecure, and that Panacea cannot guarantee the security of data sent over the internet.

Panacea’s Responsibilities:

Panacea may store and use personal information to verify compliance with the Terms and Conditions of Use of Panacea Software and Services, as well as for the provision of agreed Services to the Customer, including the development, testing, support and maintenance of Panacea Software. This information is restricted to the following kinds:

  1. Information about visits to and use of Panacea Software (length of visit, page views, website navigation paths), including information about the User’s computer (IP address, geographical location, browser type and version, operating system, referral source).

  2. Information that Users provide when registering to use Panacea Software (including the User’s business contact details and email address).

  3. Information that Users provide when completing their profile on Panacea’s website (including the User’s name and gender).

  4. Files, including documents, images and reports, uploaded to the Software or disclosed to Panacea by the Customer or their Users in order to fulfil the work they manage on Panacea Software.

  5. Details provided about the Customer’s own Users (including company and employer details, goods and services, supplier details, fees and financial details)

 

As the Data Processor, Panacea may use a User’s personal information to:

  1. Enable their use of Panacea Software and the Services.

  2. Supply the Customer and Users with Services purchased by the Customer.

  3. Provide software support and training, resolve software defects, test development and fixes to our software and run reports as requested by the Customer.

  4. Send statements, invoices and payment reminders to the Customer and User.

  5. Send the Customer and User non-marketing commercial communications.

  6. Send Users email notifications as generated by Panacea Software and any others that the Users specifically requested.

  7. Send Users Panacea’s email newsletter if they have requested it (a User can inform Panacea at any time if they no longer require the newsletter).

  8. Deal with enquiries and complaints made by or about Users relating to Panacea Software and Services.

  9. Maintain compliance with the Freedom of Information act and other legal obligations by sharing limited personal information with individuals, employers or the Customer when required. This will only ever be done in compliance with all aspects of the Data Protection Act (DPA).

  10. Verify compliance with the terms and conditions governing the use of Panacea Software and Services (including monitoring messages sent through Panacea Software’s messaging service).

  11. Notwithstanding the other provisions of this Section, Panacea will retain documents (including electronic documents) containing personal data:a. To the extent that it is required to do so by law.b. If it believes that the documents may be relevant to any ongoing or prospective legal proceedings.c. In order to establish, exercise or defend its legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).

 

Beyond these requirements, Panacea will maintain strict data protection practices:

  1. Panacea will not, without express consent, supply the Customer’s or its Users’ personal information to any third party for the purpose of their or any other third party's direct marketing.

  2. Panacea will store all personal information on secure, password- and firewall-protected servers.

  3. Panacea acknowledges that Customer Data are the Confidential Information of the Customer and will treat them as such.

  4. Personal information that Panacea processes for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

  5. Panacea may withhold personal information that a Customer or User requests to the extent permitted by law.

Cookies:

Panacea uses both “session” and “persistent” cookies on its website

  1. A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server.

  2. A “persistent” cookie will be stored by a web browser and will remain valid until its set expiry date, unless deleted by the user before the expiry date; a "session” cookie, on the other hand, will expire at the end of the user session, when the web browser is closed.

  3. The cookies Panacea uses are ASP.NET membership provider cookies, which identify the User that is logged in and displays certain information based on their login. The cookies are required to recognise if a user has already logged into the website. The cookies used are based on the session.

  4. Cookies play a role in website security and authentication. Blocking or deleting cookies will affect the security features of Panacea Software and many other Software as a Service websites. For example: a. Session Management: Many web authentication mechanisms rely on cookies to maintain session state. If cookies are blocked, this mechanism breaks down. b. Authentication: Without cookies, the server cannot keep the user logged in across different pages or requests. Every time the user navigates to a new page or makes a new request, the application would treat them as a new, unauthenticated visitor. This would prevent users from accessing any areas of the application that require authentication. c. User Experience: Users who have disabled cookies might face significant usability issues, including being unable to log in or navigate the application effectively. They may encounter continuous prompts to log in, as the application cannot remember their previous authentication state.
